Comprehensive Waiver, Release of Liability & Assumption of Risk Agreement

This Waiver and Release of Liability (“Agreement”) is executed by the undersigned parent or legal guardian (“Parent/Guardian”) on behalf of themselves and the minor participant (“Athlete”).

This Agreement applies to ALL activities, programs, and events, whether on-site or off-site, associated with:

• MAX Baseball Center

• MAX Academy

• Dream Chasers Academy

Including, but not limited to: baseball and softball training, strength and conditioning, academic enrichment, practices, games, tournaments, leagues, showcases, camps, clinics, lessons, summer camps, team trips, overnight trips, transportation, and any travel-related activities anywhere in the United States or abroad.

1. Assumption of Risk

I understand and acknowledge that participation in baseball, athletic training, strength and conditioning, academic enrichment programs, and travel-related activities involves inherent and unavoidable risks, including but not limited to:

• Serious bodily injury

• Permanent disability

• Paralysis

• Death

• Property loss or damage.

These risks may result from physical exertion, contact with other participants, equipment use or failure, facility conditions, weather, travel, transportation, or the actions or inactions of staff, athletes, or third parties.

I knowingly, voluntarily, and fully assume all risks, known and unknown, associated with my child’s participation.

2. Release of Liability (Including Death)

I hereby waive, release, and forever discharge MAX Baseball Center, MAX Academy, Dream Chasers Academy, and their owners, directors, officers, coaches, instructors, teachers, employees, volunteers, contractors, affiliates, landlords, and representatives from any and all claims, liabilities, demands, causes of action, or damages, including those resulting from negligence, serious injury, or death, to the fullest extent permitted by law.This release applies to any injury, illness, disability, or death occurring:

• At 85 Myer Street

• At any other training facility

• During travel

• At tournaments, camps, games, schools, hotels, or off-site locations

• During transportation to and from any activity

3. MAX Academy – Academic & Enrichment Program Acknowledgment

I understand that MAX Academy is an enrichment-based program that combines athletic training with structure, discipline, and educational support for middle school students (grades 7–8).

I acknowledge that:

MAX Academy is not a licensed school, MAX Academy does not replace formal schooling, Parents/guardians are responsible for academic compliance with local school requirements, Participation in MAX Academy includes physical activity and follows all athletic risk disclosures in this Agreement

4. Facility Rules & Parent Access

I understand and agree that:

• Parents and spectators are NOT permitted in the gym, turf, cages, pitching lab, or training areas unless explicitly authorized

• Parents enter the facility at their own risk

• If a parent, guardian, or spectator is injured anywhere on the premises, MAX Baseball Center and its affiliates are not responsible

• Failure to comply with facility rules may result in removal without refund.

5. Helmet & Safety Equipment Requirement

I acknowledge that:

• Batting helmets must be worn at all times during hitting, machine work, live BP, or when instructed.

• Athletes must follow all safety instructions.

• Failure to comply may result in dismissal from activities

6. Medical Authorization & Responsibility

In the event of injury or emergency, I authorize staff to secure emergency medical care if I cannot be reached. I accept full responsibility for all medical expenses, insurance claims, and related costs.

7. Conduct, Discipline & Dismissal

I understand that:

• Athletes must follow all rules, policies, and coach instructions

• Unsafe, disrespectful, or disruptive behavior may result in immediate dismissal

• Dismissal may occur without refund

8. Travel, Camps & Team Trips (All Locations Covered)

This waiver applies to all travel-related activities, including:

• Summer camp Training

• Team trips

• Tournaments Overnight stays

• Transportation (bus, van, carpool, flights)

• I accept all risks associated with travel, lodging, and off-site activities.

9. Media, Photography & Social Media Release

I grant permission for MAX Baseball Center, MAX Academy, and Dream Chasers Academy to use photographs, videos, audio recordings, and likeness of my child for promotional and marketing purposes, including Instagram and all social media platforms, without compensation.

10. Equipment Damage & Replacement Responsibility

I understand and agree that all equipment, facilities, and property belonging to MAX Baseball Center, MAX Academy, and Dream Chasers Academy must be used properly and with care.

I accept full financial responsibility for any damage, loss, or destruction of equipment or property caused by the Athlete or by myself, whether intentional or accidental, including but not limited to batting equipment, pitching machines, training tools, turf, nets, cages, gym equipment, and facility property.

I agree to repair or replace damaged equipment at the sole discretion of MAX Baseball Center, MAX Academy, or Dream Chasers Academy, and to cover all associated costs in a timely manner.

Failure to resolve equipment damage costs may result in suspension or removal from programs, teams, camps, or facility access, without refund.

11. No Guarantees

I understand that participation does not guarantee:

• Playing time

• Team placement

• Advancement

• Scholarships

• Recruitment

12. Governing Law

This Agreement shall be governed by the laws of the State of New Jersey.
