I/We hereby understand and acknowledge that the training, programs, and events held by M.A.X Baseball Center LLC Training Facility may expose me to many inherent risks, including accidents, injury, illness, or even death. I/We assume all risks of injuries associated with participation including, but not limited to, falls, contact with other participants, the effects of the weather, including high heat and/or humidity, and all other such risks are known and appreciated by me. I/we hereby understand and acknowledge the rules & regulations of M.A.X Baseball Center LLC (100 Hollister RD, Teterboro, NJ 07608) listed below. ANY VIOLATIONS OF THESE RULES WILL RESULT IN THE PARTICIPANT'S IMMEDIATE EJECTION FROM THE FACILITY AND MAY ALSO RESULT IN THE LONG-TERM LOSS OF FACILITY PRIVILEGES. IF A PARTICIPANT DAMAGES OR STEALS ANY EQUIPMENT DUE TO NOT FOLLOWING THESE RULES & REGULATIONS, THE PARTICIPANT AND/OR GUARDIAN OF THE PARTICIPANT WILL BE FULLY RESPONSIBLE TO REPLACE THE EQUIPMENT. M.A.X Baseball Center LLC is equipped with CAMERAS. 1. M.A.X Baseball Center LLC is not responsible for any injuries while using this facility. 2. All participants and guests must sign an annual release form with M.A.X Baseball Center LLC. Participants under 18 must have an annual release form signed by a legal guardian or parent. 3. EVERYONE must wear helmets always while in any of our 2 batting cages. Coaches and parents using the cage must stay behind the protective screens during live pitching or the use of any pitching machine. 4. ONLY PLAYERS & COACHES are allowed on the turf. Spectators are not allowed on the turf or office area. 5. Catchers must wear full protective gear. 6. No practice swings or swinging of bats allowed outside the cages at any time. 7. Bats must be carried by the barrel end of the bat when not in the cages. 8. Absolutely no horseplay within the facility. M.A.X Baseball Center is for use as an instructional and skill development tool only. 9. Assure that all equipment is picked up and placed where belongs after usage. 10. Leave the cage and area clean for the next group. 11. Sunflower seeds, gum, smoking, and tobacco are prohibited in our facility. 12. Immediately notify M.A.X Baseball Center LLC staff regarding any equipment, safety hazards, or unsafe conditions that may exist. 13. Participants are not allowed to wear Spikes, sandals, or Crocs during training. 14. All Participants including coaches, must carry a clean pair of sneakers during snowy days. Participants must change from their street shoes to their clean shoes inside the facility (not the parking lot). 15. The use of alcohol and profanity is prohibited in our facility. I/We hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in activity. I/We acknowledge that I am physically fit and mentally capable of performing the physical activity I choose to participate in. After having read this waiver and knowing these facts, and in consideration of acceptance of my participation and M.A.X Baseball Center furnishing services to me, I agree, for myself and anyone entitled to act on my behalf, to HOLD HARMLESS, WAIVE, AND RELEASE against M.AX Baseball Center, its officers, agents, employees, organizers, representatives, and successors from any responsibility, liabilities, demands, or claims of any kind arising out of my participation in M.A.X Baseball Center, programs and/or events. By my signature, I/We indicate that I/We have read and understand this Waiver of Liability. I am aware that this is a waiver and a release of liability and I voluntarily agree to its terms.
